Terms of Service

These Terms of Service (“Terms”) govern your use of IDA Math (the “Service”), operated by Fly Learn LLC, an Idaho limited liability company (“Company,” “we,” “us”), at idamath.com. By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Nature of the Service

IDA Math is an educational tool that helps teachers create individualized math practice for elementary students. It is provided for instructional support only. It is not a substitute for professional teaching, school curriculum requirements, or official assessments.

2. Who may use the Service

• Teachers and school staff who create and manage classroom accounts.
• Students whose accounts are created by their teacher (students do not self-register).

Use by public or private schools is voluntary. There is no obligation to use IDA Math. Schools, teachers, students, and parents may stop using the Service at any time.

3. Teacher and school responsibilities

Teachers and schools are solely responsible for:

• Creating and managing student usernames and passwords.
• Deciding which students use the Service and obtaining any required parental notice or consent under school policy.
• Supervising student use and classroom data practices.
• Complying with applicable school, district, state, and federal rules (including FERPA and school privacy policies).

IDA Math does not act as the school’s official system of record and does not replace the school’s student information system.

4. Student and parent rights

• Participation is voluntary. Parents/guardians may request that a student’s account not be used or be deleted.
• Teachers should honor reasonable opt-out and deletion requests from parents or the school.
• You may request deletion of account data as described in our Privacy Policy.

5. Acceptable use

You agree not to:

• Misuse the Service, attempt to break security, or access data you are not authorized to see.
• Upload unlawful, harmful, or inappropriate content.
• Use the Service for commercial purposes unrelated to classroom instruction.

We may suspend or terminate access for misuse or risk to the Service or other users.

6. Intellectual property

The Service, its design, and original content are owned by Fly Learn LLC or its licensors. Teachers may use generated packets and materials for their own classroom instruction. You may not resell, redistribute, or publicly republish Service materials except as allowed by your school’s normal instructional practices.

7. No warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLY LEARN LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or that content is complete or suitable for every student or standard.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLY LEARN LLC AND ITS MEMBERS, OFFICERS, AND OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM USE OF (OR INABILITY TO USE) THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM (OR $0 IF THE SERVICE WAS PROVIDED FREE OF CHARGE).

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.

9. Indemnification

To the extent permitted by law, schools and teachers agree to indemnify and hold harmless Fly Learn LLC from claims arising out of their misuse of the Service, their failure to obtain required consents, or their violation of these Terms or applicable law.

10. Changes and termination

We may update these Terms or the Service at any time. Continued use after changes means you accept the updated Terms. We may discontinue the Service or any feature with or without notice. You may stop using the Service at any time.

11. Governing law

These Terms are governed by the laws of the State of Idaho, USA, without regard to conflict-of-law rules, except where mandatory school or education law applies.
